What is a qui tam lawsuit?

The qui tam section of the False Claims Act was designed to allow citizens to initiate a civil lawsuit on behalf of the government against entities that are defrauding the government. The False Claims Act encourages whistleblowers to call attention to fraud or known illegal activity and allows them to be compensated for it.

In a qui tam lawsuit, the person bringing the lawsuit is not suing on behalf of injuries they have suffered, but rather, they are filing on behalf of the government. Once a qui tam lawsuit is filed, the government can investigate and determine whether or not to take action.

There are a number of different types of qui tam / whistleblower lawsuits, including but not limited to:

  • Healthcare, Medicare and Medicaid fraud
  • Fraudulent IRS or tax claims
  • Government or Department of Defense contractor fraud
  • Bank or brokerage scams
  • Short payment of oil & gas royalties
