About Product Liability Law
Product liability law encompasses the responsibility of a manufacturer for harm caused by a product. There are generally three types of product defects that can trigger liability for a manufacturer: design defects, manufacturing defects and marketing defects, such as mislabeling or false advertising.
Product liability law is grounded in the theory of strict liability on the part of the manufacturer. Unlike a typical negligence case, in which it must be shown that a person or entity negligently failed to use ordinary care and that the negligence caused harm to someone, in a strict liability case the manufacturer is automatically responsible if the product is shown to be defective, regardless of whether the manufacturer used ordinary care in producing the defective product.
